General Terms and Conditions (GTC) for Participants in Online Events

Scope

These GTC apply to all contracts between Dental Tribune International GmbH (hereinafter referred to as the “Organizer”) and participants (exclusively dentists or entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB), hereinafter referred to as “Participants”) in online events booked via the platform www.dawsonacademy.eu. A contract with consumers within the meaning of Section 13 BGB is excluded.

Conclusion

• The contract is concluded as soon as the participant submits a booking via the organizer's website and this is confirmed by email.
• Access data for the booked event will be sent by email in good time before the start of the event.

Services provided by the organizer

• The organizer offers digital specialist events, workshops, and seminars for dentists via its own online platform or website.
• The exact scope of services is specified in the respective event description.

Participation requirements

• Participants require a stable internet connection, a suitable device, and, if necessary, the installation of the appropriate software.
• The organizer accepts no liability for technical problems that are the responsibility of the participant.

Terms of payment

• The participation fee is due upon conclusion of the contract and must always be paid in advance.
• Accepted payment methods are credit card and PayPal.
• The organizer reserves the right to deny access to the online event in the event of late payment.
• If participation is too low, the organizer may cancel the event at short notice. All payments made will be refunded.
• All prices are subject to the applicable statutory sales tax.

Withdrawal and cancellation

• Cancellation is free of charge up to 90 days before the start of the event, minus a processing fee of €100.
• In the event of cancellation at a later date or non-attendance, the participant is not entitled to a refund.

Exclusion of the right of withdrawal

• The offer is aimed exclusively at dentists and thus at entrepreneurs within the meaning of § 14 BGB (German Civil Code).
• A right of withdrawal pursuant to § 355 BGB is excluded, as no contract with consumers is concluded.

Liability

• The organizer is only liable for damages resulting from intent or gross negligence.
• In cases of slight negligence, the organizer is only liable for breach of a material contractual obligation, but limited to the foreseeable damage typical for this type of contract.
• Liability for technical failures or disruptions to the participant's Internet access is excluded.

Copyright

• All documents, recordings, or presentations of the online event are protected by copyright.
• Reproduction, distribution, or making them publicly available without express permission is prohibited.

Data protection

• The organizer processes personal data exclusively for the purpose of processing the booking and conducting the event within the framework of its privacy policy.

Final provisions

• The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
• The place of jurisdiction is the registered office of the organizer, provided that the participant is a merchant within the meaning of the German Commercial Code (HGB).
• Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.

Allgemeine Geschäftsbedingungen (AGB) für Teilnehmer an Online-Events
Geltungsbereich

Diese AGB gelten für alle Verträge zwischen Dental Tribune International GmbH (nachfolgend „Veranstalter“) und Teilnehmern (ausschließlich Zahnärzte bzw. Unternehmer im Sinne des § 14 BGB, nachfolgend „Teilnehmer“) von Online-Events, die über die Plattform www.dawsonacademy.eu gebucht werden. Ein Vertrag mit Verbrauchern im Sinne des § 13 BGB ist ausgeschlossen.

Vertragsschluss

• Der Vertrag kommt zustande, sobald der Teilnehmer eine Buchung über die Website des Veranstalters abschickt und diese per E-Mail bestätigt wird.
• Zugangsdaten zum gebuchten Event werden rechtzeitig vor Beginn des Events per E-Mail übersendet.

Leistungen des Veranstalters

• Der Veranstalter bietet digitale Fach-Events, Workshops und Seminare für Zahnärzte über eine eigene Online-Plattform bzw Webseite an.
• Der genaue Leistungsumfang ergibt sich aus der jeweiligen Veranstaltungsbeschreibung.

Teilnahmevoraussetzungen

• Der Teilnehmer benötigt eine stabile Internetverbindung, ein geeignetes Endgerät und ggf. die Installation der entsprechenden Software.
• Für technische Probleme, die im Verantwortungsbereich des Teilnehmers liegen, übernimmt der Veranstalter keine Haftung.

Zahlungsbedingungen

• Die Teilnahmegebühr ist mit Vertragsschluss fällig und muss grundsätzlich im Voraus gezahlt werden.
• Akzeptierte Zahlungsmethoden sind Kreditkarte und PayPal.
• Der Veranstalter behält sich vor, bei Zahlungsverzug den Zugang zum Online-Event zu verweigern.
• Bei zu geringer Teilnahme kann der Veranstalter das Event auch kurzfristig absagen. Sämtliche geleitete Zahlungen werden zurückerstattet.
• Alle Preise verstehen sich zzgl. der jeweils geltenden gesetzlichen Umsatzsteuer.

Rücktritt und Stornierung

• Eine kostenfreie Stornierung ist bis 90 Tage vor Veranstaltungsbeginn abzüglich einer Bearbeitungsgebühr von 100€ möglich.
• Bei einer Stornierung zu einem späteren Zeitpunkt oder Nichterscheinen hat der Teilnehmer keinen Anspruch auf Rückerstattung.

Ausschluss des Widerrufsrechts

• Das Angebot richtet sich ausschließlich an Zahnärzte und damit an Unternehmer im Sinne des § 14 BGB.
• Ein Widerrufsrecht nach § 355 BGB ist ausgeschlossen, da kein Vertrag mit Verbrauchern zustande kommt.

Haftung

• Der Veranstalter haftet nur für Schäden, die auf Vorsatz oder grober Fahrlässigkeit beruhen.
• Für leichte Fahrlässigkeit haftet der Veranstalter nur bei Verletzung einer wesentlichen Vertragspflicht, jedoch beschränkt auf den vorhersehbaren, vertragstypischen Schaden.
• Eine Haftung für technische Ausfälle oder Störungen des Internetzugangs des Teilnehmers ist ausgeschlossen.

Urheberrechte

• Alle Unterlagen, Aufzeichnungen oder Präsentationen des Online-Events sind urheberrechtlich geschützt.
• Eine Vervielfältigung, Verbreitung oder öffentliche Zugänglichmachung ohne ausdrückliche Genehmigung ist untersagt.

Datenschutz

• Der Veranstalter verarbeitet personenbezogene Daten ausschließlich zur Abwicklung der Buchung und Durchführung des Events im Rahmen seiner Datenschutzerklärung.

Schlussbestimmungen

• Es gilt das Recht der Bundesrepublik Deutschland, unter Ausschluss des UN-Kaufrechts.
• Gerichtsstand ist der Sitz des Veranstalters, soweit der Teilnehmer Kaufmann im Sinne des HGB ist.

Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Gültigkeit der übrigen Bestimmungen unberührt.
